Please read these Terms of Service ("Terms") carefully before using the SubQuester mobile application (the "App") operated by Klikkit ("us", "we", or "our").

1. Acceptance of Terms

By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the App.

2. Description of Service

SubQuester is a gamified travel companion that generates quests and activities for users. The App provides suggestions for activities, points of interest, and travel goals.

3. Physical Safety and Risk

IMPORTANT: The App encourages real-world movement and travel. You acknowledge and agree that:

  • You are solely responsible for your safety and well-being while participating in any quests or activities suggested by the App.
  • You must always be aware of your surroundings and follow all local laws, regulations, and safety guidelines.
  • We are not liable for any injury, damage, or loss that may occur while you are using the App or visiting any location suggested by the App.
  • Suggestions provided by the App (e.g., POIs, locations) are for informational purposes only. Verification of safety and accessibility is your responsibility.

4. Subscriptions and Purchases

The App offers a "Pro" version available via subscription or one-time purchase.

a. Subscriptions

  • Auto-Renewal: Your subscription will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Billing: Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the then-current price.
  • Management: You can manage and cancel your subscriptions by going to your App Store Account Settings after purchase.
  • Free Trials: Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription, where applicable.

b. Lifetime Purchase

The "Lifetime" option is a one-time non-consumable purchase that grants access to premium features for the lifetime of the App's availability on the App Store. This is not a subscription and does not renew.

c. Refunds

All purchases are processed by Apple. We cannot issue refunds directly. You must contact Apple Support for any refund requests in accordance with their policies.

5. Intellectual Property

The App and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of Klikkit and its licensors.

Your "User Content" (journals, photos, notes you invoke locally) remains yours. Since the App stores data locally or on your personal iCloud, we do not claim ownership over your personal memories.

6. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the results of using the App will meet your requirements or that the service will be uninterrupted or error-free. We do not guarantee the accuracy of map data or Point of Interest information provided by third parties (e.g., Apple Maps).

7. Limitation of Liability

In no event shall Klikkit be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the App;
  • Any conduct or content of any third party on the Service;
  • Any content obtained from the App.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any significant changes by updating the "Last Updated" date at the top of these Terms.
